In Order to Market your property for sale you will require an up to date Energy Performance Certificate. If your property has been sold in the last 10 years there is a good chance your property will already have one in place. You can check this for free at . If your property requires an EPC we can arrange this for you



Regarding the For Sale board, it is necessary for us to have your agreement prior to erection, and your signature on this AGREEMENT will be taken as consent. The For Sale board is seen as a highly visible and important part of the marketing package and, if you do not wish to proceed with one, you must specifically instruct us thus.


We are legally obliged to ensure that your sales particulars are factual, accurate and in no way misleading. We will prepare and forward draft sales particulars to you and require you to check these carefully, with particular reference to the tenure being either freehold or, if leasehold, that it is shown in the correct terms. If in doubt, please consult us. Please note that sales particulars will not be made available to prospective purchasers until they have been approved and signed by you and returned to this office.

The Estate agency  fee is payable only upon exchange of unconditional contracts (or on completion, if there is no prior contract) and should be settled in full on the date of completion. On signing this agreement, you hereby irrevocably confirm your agreement that we, as your solicitor and legal representative, shall be authorised to deduct the sale fee from the proceeds of the sale upon completion. In the event of completion failing to take place on the due date, the sale fee will, nevertheless, become payable, unless an alternative payment date has been mutually agreed. You confirm that, at the date of this agreement, there is no prospective purchaser, from any source, who has expressed an interest in purchasing your property, or that you have given details to us of all prospective purchasers known to you.

This fee covers routine legal services relating to the sale, but does not include expenses (disbursements) such as obtaining Official Copies from the Land Registry or Copy Planning Permissions. This does not include the extra work required for a leasehold property which will be charged at £150 plus VAT in addition to the above fee. This does not include the Conveyancing costs for any abortive sale.  These will be charged for in accordance with the work undertaken. At your request, we will quote for any special additional promotional or other activity. The cost, nature and payment terms of which will be agreed first and then confirmed in writing separate to this agreement.


In the event of Elmhirst Parker LLP agreeing a sale of the Property to a prospective purchaser who does not proceed then the Seller shall be liable to pay the legal fees incurred in respect of the abortive sale such fees to be calculated on a time basis in accordance with the standard terms and conditions of Elmhirst Parker LLP as attached to this agreement together with VAT and any disbursements incurred.


If our agreement is brought to an end, before a prospective purchase is found by Elmhirst Parker LLP, we will operate on a NO SALE NO FEE basis, subject to the following:

This excludes any disbursement costs this firm has incurred on your behalf.


We will be your sole agent for a minimum of 13 weeks from the date of this agreement. The agreement will continue after this 13 week period until unconditional contracts have been exchanged for the sale of the property and the completion has taken place, or until the expiry of 14 days written notice given by either party to the other to terminate the sole agency.


In order to instruct us to sell your property, we require

  • Photographic ID for all sellers (passport or driving licence).

  • Some form of proof of address from within the last three months (utility bill or similar).

  • A completed signed agreement.

  • Payment for EPC (if required)
